By accessing and using the services provided by our Website you signify your consent and agreement to be bound by these Terms and Conditions. Desai Gold reserves the right to change these Terms and Conditions from time to time without any obligation to inform you and it is your responsibility to check for recent updates. Any updates to these Terms and Conditions shall take effect immediately upon the date of posting and you agree to be bound by such updates and amendments.

Disclaimer

All products and the information displayed on the Desai Gold Website/Web-App constitute an invitation to offer. Your order for purchase constitutes your offer which shall be subject to the terms and conditions listed herein. We reserve the right to accept or reject your offer in part or in full. Our acceptance of your order will take place upon dispatch of the product(s) ordered. Dispatch of product(s) ordered may or may not happen at the same time. In such a scenario, the portion of the order that has been dispatched will be deemed accepted by us and the balance will continue to be an offer to us and we reserve the right to either accept or reject the remaining offer.

No act or omission of Desai Gold prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer. If you have provided us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and to confirm dispatch and therefore acceptance of the order.

We have made every effort to display the colours and sizes of our products on the Website as accurately as possible. However, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. Packaging of the product may vary from that displayed on the Website.

Eligibility Criteria

If you are below 18 years of age, you are prohibited from using, purchasing or contracting from or with this Website. Persons who are incompetent to contract within the meaning of the Indian Contract Act, 1872 are not eligible to use or transact through this Website. Those who choose to access this Website from outside India are responsible for compliance with local laws to the extent such laws are applicable.

Pricing & Payment

Domestic Orders

Prices on our Website are subject to change without notice. You will be charged the price for the jewellery as listed on the day of purchase. For orders shipped within India, payment in INR is accepted. Prices are inclusive of CGST/SGST/IGST, as applicable. In case international credit cards are used for domestic orders, the transaction amount will be converted to INR before the payment is accepted. Currency conversion charges may apply as per your credit card policy.

You may be required to share a copy of any government-issued photo identity proof of the country of residence, such as:

Passport with Visa copy
Driving License
Employment Card
Any other government-issued ID proof of the country of residence

Custom / Make-to-Order Products

All custom-made or made-to-order jewellery is manufactured based on customer specifications and requirements. Due to the nature of the manufacturing process, the final weight of the product may vary from the initially estimated or quoted weight.

If the actual weight is higher than estimated, the customer shall be liable to pay the difference amount.
If the actual weight is lower than estimated, the customer shall be eligible to receive a refund of the difference amount, subject to applicable terms.
The final billing shall be based on the actual weight and prevailing rate at the time of completion/manufacture, unless otherwise agreed.
By placing an order for a custom or made-to-order product, the customer expressly agrees to and accepts such variation and the corresponding financial adjustment.

International Orders

Please enquire to us via our Contact Us page. All rates are subject to change and any additional costs will be borne by the customer as per actuals at the time of delivery.

PAN Card Terms & Conditions

For purchases above Rs. 50,000/-, PAN card must be provided upon placing the order in the manner specified by Desai Gold. Failure to provide the same may result in cancellation of the order.

Shipping Destinations

Within India, we currently serve selected cities. Please check whether we deliver to your PIN Code on the shopping cart checkout page. If no courier service is available in your area, we regret the inconvenience.

Delivery Schedule

Domestic Orders

A tentative delivery date/time will be given along with the order confirmation email. The exact delivery date shall be provided as soon as your order is ready for dispatch. Registered customers can track their order via the Track Order functionality.

Express delivery is available for select PIN Codes in select cities (Delhi, Mumbai, Hyderabad, Chennai and Bengaluru) for select products. Under this option, the product will be delivered the next day provided the order is placed by 2 PM. Orders placed after 2 PM will have tentative delivery timelines of T+2 days. If the delivery timeline falls on a public holiday or Sunday, the timeline for express delivery will be extended by another day. For all other PIN Codes, domestic delivery timelines will generally be 5–7 days.

NOTE: At present we do not offer delivery of a single order to multiple destinations. Please place separate orders for shipment to multiple destinations.

Shipping & Handling Charges

Domestic Orders: Shipping is calculated at checkout and must be paid by the customer at the time of placing the order.

International Orders: For orders shipped outside India, the customer shall bear shipping and handling charges plus any import duty applicable at the destination. If an order is not accepted by the customer and returned to origin, freight charges and import duty will be levied to the customer.

Custom Clearance

All jewellery shipments exported from India require clearance by the Indian Customs office. Products and documentation are submitted for inspection, examination and assessment prior to delivery. Please ignore package messages that state "Please do not accept if the package is received in Open/Tampered condition" when customs inspection is applicable; you may find the package sealed with a label stating "Opened for Customs".

Logistics Service Provider

Our domestic and international logistic partners will be communicated on the order/booking confirmation. [Courier Name] is used as an example placeholder where applicable.

NOTE: For international orders, customers must pay shipping charges at the time of placing the order. Customs duty and taxes levied by the destination country shall be borne by the customer and payable to the logistics partner at time of delivery. All consignments are delivered on a Delivery Duty Unpaid (DDU) basis unless otherwise stated.

Your Obligations

You must provide true, accurate, current and complete information about yourself when registering on www.desaigold.com.
You should maintain and promptly update registration data to keep it true, accurate, current and complete. Desai Gold reserves the right to confirm and validate the information provided at any point in time and to request additional information before accepting orders or making delivery.
You confirm that the delivery address provided is correct. If non-delivery occurs due to incorrect information provided by you, any extra cost for re-delivery will be claimed from you.
Before placing an order you shall check the product description carefully. By placing an order you agree to be bound by the conditions of sale and invitation to offer included in the item’s description.
If delivery is delayed due to a force majeure event (including natural calamity, governmental action, pandemic, public holiday or other unforeseen circumstances), Desai Gold shall not be liable for such delay.
Any product purchased from our Website is at your discretion. Desai Gold is not liable for damages or losses suffered by customers due to use of the product. This applies to both domestic and international orders.

Cancellation By Desai Gold Pvt Ltd.

Desai Gold reserves the right, at its sole discretion, to refuse or cancel any order. Reasons may include limitations in quantity, errors in pricing or product information, suspected fraud, or any other issue identified by Desai Gold. Where special documentation is required by law for inter-state sale, we retain the right to accept or reject such orders. We may request additional information prior to accepting certain orders and will notify you if your order is cancelled fully or partially or if more information is required.

Cancellation By Customer

Cancellation is permitted only under the following conditions:

Custom/Made-to-Order Products: Orders for customized or made-to-order products cannot be cancelled once confirmed.
Standard Products: Cancellations for standard (non-customized) products are allowed only if the request is made before the order has been dispatched from our facility.
Post-Dispatch: Once an order has been dispatched, cancellation requests will not be accepted.

Desai Gold reserves the right to accept or reject any cancellation request at its sole discretion.

Restriction

Desai Gold may, at its sole discretion, limit the quantity or value of items purchased per account, per payment instrument, or per shipping/billing address. We will notify the customer if such limits apply and reserve the right to prohibit sales to anyone as deemed fit.

Return Policy & Return Charges

Returns are accepted subject to the following conditions:

Return Window: Customers must initiate a return request within 24 hours of delivery of the product.
Return Dispatch: The product must be dispatched back within 24 hours from the time of delivery, either in person or through a recognized courier service with appropriate insurance coverage.
Return Shipping Charges: All costs associated with return shipping, including courier and insurance charges, will be borne entirely by the customer.
Condition of Return: The product must be returned in its original condition, unused, and with all original packaging, certificates, invoices, and tags intact.
Quality Check (QC): Upon receipt, the returned product will undergo a QC process which may take 5 working days or more.
Approval of Return: Acceptance of the return is subject to successful completion of the QC and verification process.
Refund Processing: Refunds (if applicable) will be processed in accordance with our Refund Policy. Desai Gold reserves the right to reject returns that do not comply with these conditions.

Refund Policy

Once the refund process has been initiated, the amount will be refunded via the same mode of payment used for the transaction, or through cheque where the original card is no longer in use (cheque refunds apply only in such cases).

Refund Eligibility & Approval

Refunds shall be processed only after the returned product has been received and approved post QC. The product must be unused, undamaged and returned in original packaging with original tags, certificates and invoice. If the product fails QC, no refund will be processed.

Refund Amount Calculation

Refunds will be processed only for the actual metal value of the product. All additional charges including making charges, packaging, shipping, taxes and any other charges shall be non-refundable. The market rate of the metal applicable on the date of QC approval will be considered for calculating the refund amount.

Domestic Orders

Where returns are accepted and approved, refunds for online payments will be processed within 7–15 working days from the date of receipt and approval of the returned product at Desai Gold’s warehouse.

Cash on Delivery (COD) Orders

Refunds for COD orders shall be processed based on the customer’s preference, subject to the following:

Online Transfer (NEFT): If a cancelled cheque is provided with the returned product, refund via NEFT will be processed within 7–15 working days of QC approval.
Cheque Refund: If no cancelled cheque is provided, refund will be issued via cheque and couriered to the address provided when placing the order. This may take up to 30 working days.

Desai Gold shall not be responsible for delays or losses due to incorrect or incomplete address details provided by the customer. Desai Gold reserves the right to refuse refunds in cases of non-compliance with these conditions.

Desai Gold Products Exchange Program

Products purchased from the Website may only be exchanged at Desai Gold stores.

1. Desai Gold Products Exchange

Jewellery sold through any Desai Gold outlet or the brand website will be accepted for exchange at the store, subject to prevailing exchange policy operated at the Company’s discretion.
24kt, 22kt, 18kt, 14kt gold and studded jewellery, and platinum jewellery will be accepted for exchange after examination for purity, defects, weight, originality, damage or stone defects. Items with discrepancies will not be accepted.
Original invoice and certificate of authenticity must be produced for any exchange.
Terms for valuation on the day of exchange:
1. Gold / plain platinum products will be valued at 100% prevailing metal rate at the respective stores on the day of exchange.
2. Diamonds (on studded gold / platinum products) will be valued at 100% prevailing stone rate on the day of exchange.
3. Solitaire (loose or studded) will be valued at 100% prevailing stone rate if customer buys studded gold/platinum product against the exchange.
4. Solitaire (loose or studded) will be valued at 90% prevailing stone rate if the customer buys plain gold/plain platinum product or coin against exchange.
5. No exchange for solitaires of 2 carats and above.
6. Other studded products will be valued at 80% of prevailing value of the product.
7. Any other category not mentioned above will be subject to store terms and prevailing conditions.
8. Making charges, taxes, and any discount given on the original invoice will be deducted in full.

The exchange program may be withdrawn or modified without prior notice. Any exceptions will be at the sole discretion of the Company. For more details contact your nearby store or customer care.

Other Products Exchange Program

24kt, 22kt, 18kt Gold jewellery products not purchased from Desai Gold will be accepted for exchange only at our stores, subject to Company terms.
Plain gold jewellery only will be accepted for exchange.
No exchange is available for studded products.
The product will be valuated after purity determination by Karatmeter and melting.
Deductions will be applicable for exchange; please consult your chosen store for details.
No cash refund will be provided for exchange.

The general exchange program may be withdrawn or modified without prior notice. Any exceptions will be at the sole discretion of the Company.

Site Security

You are prohibited from violating or attempting to violate the security of this website, including without limitation:

Accessing data not intended for you or logging onto a server or an account which you are not authorized to access.
Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
Attempting to interfere with service to any other user, host or network, including submitting a virus, overloading, flooding, spamming, mail-bombing or crashing.
Sending unsolicited email, including promotions and advertising of products or services.
Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting.

Such violations may result in civil or criminal liability. Desai Gold will investigate occurrences and may cooperate with law enforcement authorities in prosecuting users involved in such violations.

Fraudulent Transaction

Desai Gold reserves the right to recover the cost of goods, collection charges, damages and legal expenses from persons using this Website fraudulently. Desai Gold reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website or other unlawful acts in breach of these Terms and Conditions.

Gift Card

Value & Denomination: Gift Cards can be purchased for a minimum value of INR 1,000. Any additional value must be in multiples of INR 100.
Validity: Each Gift Card shall be valid for a period of 6 (six) months from the date of purchase. Any unused balance after expiry shall lapse without refund or extension.
Issuance & Delivery: Gift Cards will be delivered electronically via Email and/or SMS to the Beneficiary, subject to accurate details provided by the buyer. Desai Gold shall not be responsible for incorrect details.
Access & Resend: The buyer may access and resend the Gift Card to the Beneficiary from their account before redemption.
Irrevocability of Details: Once issued, Gift Card details cannot be modified, transferred, or reassigned.
Usage & Verification: The Beneficiary must provide valid government-issued identification at time of redemption/purchase using the Gift Card. Failure to provide valid identification may result in order cancellation.
Non-Cancellable & Non-Refundable: Gift Cards are non-cancellable, non-refundable and cannot be exchanged for cash.
Loss or Misuse: Desai Gold shall not be responsible for loss, theft, unauthorized use or misuse of the Gift Card.

Desai Gold reserves the right to amend or withdraw the Gift Card program or its terms at any time without prior notice.
